Simply Unified – ABN Advantage Rental Agreement

Terms & Conditions

This Agreement sets out the terms under which Simply Unified Pty Ltd (“Simply Unified”, “we”, “us”, “our”) supplies devices and related services to the Customer (“you”, “your”) under the ABN Advantage Rental Program.

1. Eligibility
  1. Participation is open only to businesses holding a valid Australian Business Number (ABN).
  2. Proof of ABN may be requested and must be supplied on application.
  3. This program applies to eligible Simply Unified devices, including but not limited to the SU-2700, SU-3300, and SU-6700.
2. Rental Term
  1. The standard rental term is twenty-four (24) months, commencing on the delivery date.
  2. At the end of the term, and provided all rental payments are up to date, you may choose to:
    1. Continue with the device at $27 + GST per month on a rolling basis, in which case the device remains under the same warranty coverage; or
    2. Elect to take ownership of the device by paying a one-off fee of $39 + GST, subject to clause 2.3.
  3. Ownership transfer will only occur if:
    1. All rental payments are current and fully paid; and
    2. The one-off ownership transfer fee has been received in full; and
    3. The device is subscribed to a current service-only plan.
3. Rental Inclusions
  1. Each rental includes:
    • Device hardware (pre-configured, ready to use).
    • SIM card and data plan.
    • Full access to the Simply Unified platform, including mapping, alerts, and reporting.
    • Unlimited geofence entry/exit alerts.
    • Daily and/or scheduled reports.
    • Tamper, low-battery, and connectivity notifications.
    • Theft recovery mode.
  2. Simply Unified provides warranty coverage and will replace faulty devices during the rental term or rolling rental period at no additional cost.
4. Payments
  1. Rental fees are $27.00 + GST per month, billed quarterly in advance.
  2. Fees include device hardware, SIM card, data plan, and full access to the Simply Unified platform (mapping, geofencing, alerts, and reporting).
  3. Payments must be made by credit card, direct debit, or approved account terms.
  4. Simply Unified may apply a one-time setup or delivery fee, notified in advance.
  5. All prices are in Australian Dollars and include GST.
5. Customer Obligations
  1. You must:
    • Take reasonable care of all devices.
    • Notify Simply Unified immediately if a device is lost, stolen, or damaged.
    • Not sell, transfer, or sub-lease the device without prior written consent.
  2. Until ownership transfers under clause 2.3, the device remains the property of Simply Unified.
6. Termination
  1. You may terminate this Agreement early by paying the remaining rental balance in full.
  2. Simply Unified may terminate this Agreement immediately if:
    • You fail to make payment when due;
    • You misuse the device or breach these Terms; or
    • We reasonably believe continuation of the Agreement would cause loss or risk.
  3. Upon termination, devices must be returned or outstanding amounts settled in full.
7. Ownership Transfer
  1. At the end of the 24-month rental term, you may choose ownership in accordance with clause 2.2(b).
  2. Ownership will only transfer once the conditions in clause 2.3 are satisfied.
  3. If you continue on the rolling $27 + GST per month arrangement, ownership does not transfer and the device remains covered under warranty for as long as payments are maintained.
8. Liability
  1. Simply Unified’s liability is limited to the repair or replacement of devices as outlined in clause 3.2.
  2. We are not liable for any indirect, incidental, or consequential loss arising out of the use or inability to use the device or services.
9. Governing Law
  1. This Agreement is governed by the laws of Western Australia, Australia.
  2. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
